Mackie Motors pushes ahead with High Court legal for termination in 2021

Mackie Motors is pushing ahead with legal action against Renault UK, Nissan Motor (GB) and RCI Financial Services over its termination in 2021.

In Claim No. LM-2025-000270 lodged in the High Court it is seeking damages for lost profits, business value, and unreimbursed investment in seized vehicle stock.

The dealer group has appointed Motor Industry Legal Services to represent its interests.

The full claim from Mackie and the counter claim from Nissan, Renault and RCI Financial Services have now been lodged in the High Court.

Mackie had been a franchise partner of Renault, Dacia, and Nissan for 45 years until its contract was terminated by RCI on unsubstantiated claims of money laundering.

In the claim MMBL alleges that RCI, Nissan and Renault all cut off access to critical operational systems used to order parts, process sales, and provide aftersales support.

It alleges that this “sudden disruption” effectively “shut down its operations” and “forced the sale” of the business properties and assets at a significant loss.

Critically, in the Defence and Counterclaim document, Nissan and Renault argue that did not have to provide the database and platform under the Franchise Agreement.

It can neither be obvious or necessary to require Renault to provide access to databases and systems it neither developed nor controls and any such implied term would contradict the express wording of the Renault Agreement,” it said in its defence and counterclaim document.

MMBL also accuses RCI Financial Services of playing a central role, alleging it pressured Renault and Nissan to terminate franchise agreements based on unsubstantiated internal suspicions.
