Mackie Motors boss Keven Mackie has filed a complaint with the European Commission under Articles 101 and 102 TFEU and Regulation (EU) No. 461/2010 (MVBER) against Renault Nissan Motors GB RCI Bank and Services.
“I’m delighted to confirm that this morning I received formal acknowledgment from the European Commission of my complaint under Articles 101 and 102 TFEU and Regulation (EU) No. 461/2010 (MVBER) against Renault Nissan Motors GB RCI Bank and Services,” he said.
The complaint alleges the manufacturers disregarded the 24-month termination clauses designed to protect dealers from overnight cut-off when they terminated Mackie Motors in 2021.
“I now look forward to providing the Directorate-General for Competition (DG COMP) with further evidence regarding these practices and their wider implications for competition, consumer rights, and the credibility of the franchised dealer network,” said Mackie
Under EU competition law, the European Commission has the power to impose fines of up to 10% of a company’s worldwide turnover for breaches.
“We look forward to the High Court hearing in London, where Renault Group and Nissan Motors GB will finally face the courtroom for the first time and where this fight for fairness for customers and communities will take place,” said Mackie.
In a statement Renault said: “We cannot comment on ongoing legal matters, beyond noting that previous claims made by Mackie Motors were struck out in their entirety by both the High Court and the Court of Appeal.”
